With the Law No. 6698 on the Protection of Personal Data (“Law”), important obligations have been imposed on personal data processors in order to protect the fundamental rights and freedoms of individuals, especially the privacy of private life. Processing of Personal Data

Automatic means of personal data wholly or partially or non-automatically provided that they are part of any data recording system It refers to all kinds of operations performed on data such as obtaining, recording, storing, preserving, changing, rearranging, explaining, transferring, taking over, making it available, classifying or preventing its use.

Private Personal Data

Represents the personal data class of the data subject group or groups in which personal data are grouped according to their common characteristics.

Refers to the guiding procedure that determines the details of the Data Subject's right to apply to the Company, which is the Data Controller, recognized in Article 11 of the Law, and the Company's response process regarding the application.

Data Controller

Represents the natural or legal persons who determine the purposes and means of processing personal data and are responsible for the establishment and management of the data recording system, and the Company responsible for this activity, in particular with this Clarification Text.

3. Cookies Used in the Online Area

3.1. What is a Cookie?

Cookies refer to text files, mostly letters and numbers, placed on the device or server of the Relevant Person by browsers as a result of visiting the Online Domain, enabling the device to be recognized.     6.1.Domestic Transfer

    Data processed with cookies can be transferred domestically, as a rule, if there is explicit consent of the Relevant Person. If there is a clear regulation regarding the transfer of data, it can be transferred. Personal data without the explicit consent of the Relevant Person;
    i. If it is necessary for the protection of the life or bodily integrity of the personal data owner or someone else, and if the personal data owner is unable to express his consent due to actual impossibility or if his consent is not legally valid, it can be transferred to third parties.
    ii. If it is necessary to transfer the personal data of the parties to the contract, provided that it is directly related to the establishment or performance of a contract, personal data may be transferred to third parties.
    iii. If personal data transfer is mandatory for the Company to fulfill its legal obligations, personal data may be transferred to third parties.
    iv. If personal data has been made public by the personal data owner, it may be transferred to third parties for the purpose of making it public limited.
    v. Personal data may be transferred to third parties if personal data transfer is necessary for the establishment, exercise or protection of a right.
    vi. Provided that it does not harm the fundamental rights and freedoms of the Related Person, personal data may be transferred to third parties if it is necessary for the legitimate interests of the Company.

    6.2. Transfer to Abroad

    The Company transfers the personal data it processes through cookies to abroad only in case of the Explicit Consent of the Relevant Person.

    ii. If it is necessary for the protection of the life or bodily integrity of the personal data owner or someone else, and the personal data owner is unable to express his consent due to actual impossibility or if his consent is not legally valid, it can be transferred abroad.
    iii. If it is necessary to transfer the personal data of the parties to the contract, provided that it is directly related to the conclusion or performance of a contract without the express consent of the Relevant Person, the personal data may be transferred abroad.
    iv. If personal data transfer is mandatory for the Company to fulfill its legal obligations, personal data may be transferred abroad.
    v. If the personal data is made public by the owner, it can be transferred abroad on a limited basis for the purpose of making it public.
    vi. Personal data may be transferred abroad if personal data transfer is necessary for the establishment, exercise or protection of a right.
    vii. Personal data may be transferred to third parties without the express consent of the Related Person, provided that the fundamental rights and freedoms of the Related Person are not harmed, if personal data transfer is necessary for the Company's legitimate interests.
    a) Private Personal Data; The Company is responsible for the Explicit Disclosure of the Related Person by applying the administrative and technical measures and by complying with the special measures taken by the Board. It can be transferred abroad with its consent. In order for the Company to transfer Sensitive Personal Data abroad even without obtaining the Explicit Consent of the Related Person, the country or countries to which the personal data will be transferred must be (a) one of the countries declared to have sufficient protection by the Board, or (b) not one of the countries announced by the Board. The permission of the Board must be obtained by obtaining a written commitment from data controllers in the relevant foreign country, providing adequate protection, and (c) the presence of one or more of the following conditions.
    i. Special Quality Personal Data excluding health and sexual life: If the company is expressly stipulated in the legislation, without the explicit consent of the data owner, Special Qualified Personal Data excluding health and sexual life It will be able to process Personal Data.
    ii. Special Quality Personal Data on Health and Sexual Life: Protection of public health, preventive medicine, medical diagnosis, treatment and care services, health may be processed without seeking explicit consent by persons or authorized institutions and organizations under the obligation of secrecy for the purpose of planning and management of services and financing.

    7. Method and Legal Reason for Personal Data Collection

    The company acts in accordance with the basic principles and the Law on this subject, as well as its approach to processing personal data in general, during the use of cookies. The method and purposes of data collection with cookie technology are detailed in the light of the above articles.
    Personal data collected for this purpose and legal reasons are covered in 3.5 of the Clarification Text within the scope of the personal data processing conditions and purposes specified in Articles 5 and 6 of the Law. . , may also be processed and transferred for the purposes specified in articles 4 and 6.

    8. Rights of the Relevant Person and Application to the Company

    8.1. Rights of the Relevant Person

    The Relevant Person has the right to apply to the Company regarding his personal data in the following matters;

    iii. Learning the purpose of processing personal data and whether they are used in accordance with its purpose,
    iv. Knowing the third parties to whom personal data is transferred at home or abroad,
    v. Requesting correction of personal data if it is incomplete or incorrectly processed,
    vi. Request deletion or destruction of personal data,
    vii. In case of incomplete or incorrect processing of personal data, requesting the notification of third parties to whom the personal data has been transferred, of the actions regarding their correction and/or the deletion or destruction of personal data,
    viii. Objecting to the emergence of a result against the person by analyzing the processed data exclusively through automated systems,
    ix. Demanding the compensation of the damage in case of loss due to unlawful processing of personal data.

    8.2. Application to the Company

    The Company has prepared a Procedure in order to protect the rights of the Related Person regulated in the Law and this Clarification Text and to fulfill its obligations in this regard. In accordance with this Procedure, the Company makes the utmost effort to provide the information requested by the Company regarding the personal data of the Relevant Person free of charge, within thirty days at the latest, as soon as possible. If the transaction also requires a cost, the fee in the tariff determined by the Board may be collected from the Related Person. The Company accepts the request as a result of the examination or rejects it by explaining its reason and notifies the Related Person in writing or electronically. In case the request in the application is accepted, the Company fulfills the requirements of the request. In case the application is caused by the Company's fault, the fee collected is returned to the Related Person.
